Order Of Protection

No person should have to live in fear of domestic violence. If you have been the victim of violence or threats of violence, you may seek an order of protection, which may protect you, your children, and pets.  Domestic violence comes in many forms, including physical, verbal or emotional which includes verbal abuse, harassment, threats, stalking, and intimidation, sexual, and financial abuse. If you have been the victim of violence or threats of violence, you may seek an order of protection, which may protect you, your children, and pets. Orders of protection offer various remedies to those protected, such as stay away orders from the person’s home, work or school, no contact orders, denials of parenting time, relinquishing any firearms or attending court-mandated domestic violence programs and therapy.  Orders can be brought without giving notice to the other side and on an emergency basis if appropriate. Protective orders are issued as a civil, not criminal, order, but the police can be called and the offender may be arrested if an order is violated.

If you have been accused of domestic violence and your spouse or significant other is seeking an order of protection, you must act immediately to protect your rights and potentially that of your child’s. Unfortunately, some individuals make false allegations of abuse to obtain an upper hand in divorce proceedings (even when there is not yet a divorce case started). Time is of the essence is these situations to defense against and attempt to “vacate” or get rid of, the order of protection.
